The Austin History Center (AHC) provides you with access to and reproduction of some collection materials based on your agreement to the following terms. Please note the Austin History Center reserves the right to deny copy order requests, limit the number of copies, restrict the use or reproduction of collection materials, and charge special reproduction fees on items involving unusual difficulty in copying.
- Indemnification: Patron shall defend, indemnify, and hold harmless the City of Austin and Austin History Center, its officers, employees, and agents against all liabilities, damages, and expenses, including attorneys' fees, resulting from any claims and other proceedings by any third party for copyright infringement or any other legal or regularoty cause of action arising from the Patron's use of Austin History Center collection materials.
- No Transfer of Intellectual Property Rights or Permission to Use: In no event does the City of Austin or Austin History Center grant or transfer any copyright or other intellectual property rights to the patron.The Austin History Center's reproduction or access of collection materials provided for a patron does not include or imply permission from the City of Austin and Austin History Center to use the copies in a publication, performance, broadcast, or display.
- Patron's Responsibility: It is the patron's responsibility to comply with copyright law, other applicable law, and donor restrictions which may be involved in the use of the Austin History Center collection materials.
NOTICE WARNING CONCERNING COPYRIGHT RESTRICTIONS
The copyright law of the United States (Title 17, United States Code) governs the making of photocopies or other reproductions of copyrighted material.
Under certain conditions specified in the law, libraries and archives are authorized to furnish a photocopy or other reproduction. One of these specific conditions is that the photocopy or reproduction is not to be "used for any purpose other than private study, scholarship, or research." If a user makes a request for, or later uses, a photocopy or reproduction for purposes in excess of "fair use," that user may be liable for copyright infringement.
This institution reserves the right to refuse to accept a copying order if, in its judgment, fulfillment of the order would involve violation of copyright law.
